Essence of the Problem
The client ended up in Interpol’s international database at the request of Russian law enforcement authorities. The basis for the search was a theft allegedly committed in 2016 in the Leningrad region.
An Interpol diffusion was published regarding the client, based on an arrest warrant issued by a Russian court. Despite the fact that it was a minor property crime, the information remained in the international search system, creating serious risks:
- detention abroad,
- extradition,
- restrictions on freedom of movement,
- problems with migration status.
The client turned to the Commission for the Control of Files (CCF) requesting the removal of the data as disproportionate and violating international cooperation principles.
Prosecution’s Position and State Demands
The Russian side argued that:
- in 2016, construction equipment was stolen;
- the damage amounted to about 106,000 rubles;
- an arrest warrant was issued in the case;
- the crime falls under criminal liability.
On this basis, Russia insisted on retaining the diffusion in Interpol’s database.
Defense Arguments and Key Circumstances
The defense built its position on several key aspects:
1. Lack of Interest for International Search
It was pointed out that:
- it was a minor property crime;
- the act was non-violent;
- the amount of damage was insignificant;
- the case was not connected to organized crime.
2. Expiration of Statute of Limitations
The key argument was the decision of the Hungarian court:
- the client was detained in Hungary in 2022;
- the Hungarian court denied extradition;
- the court established that the statute of limitations had expired;
- further prosecution was deemed impossible.
3. Disproportionality of Measures
The defense pointed out that:
- an international search for a minor crime from 2016 violated the principle of proportionality;
- further retention of the data in Interpol was not serving the purpose of international cooperation;
- maintaining the search was formal and repressive in nature.
Interpol Commission Assessment
The Commission carefully analyzed the case materials and came to the following conclusions:
- the crime does not fall under the category of serious crimes;
- the damage is minimal;
- there is no international public danger;
- extradition has already been officially rejected by the Hungarian court;
- the statute of limitations has expired;
- the retention of data is contrary to the principles of necessity and proportionality.
It was specifically noted that:
this case is not of interest to international police cooperation.
Final Decision
Following the review of the petition, the Commission for the Control of Files of Interpol concluded that the processed data did not meet Interpol’s rules.
The Commission established that:
- the alleged offense is of minor significance,
- the damage is insignificant,
- the crime does not fall under serious criminal offenses and does not represent an interest for international police cooperation,
- the statute of limitations for criminal prosecution has expired,
- the client’s extradition was officially denied by competent authorities of a foreign state.
Considering these circumstances, the Commission deemed the further retention and dissemination of the information in the Interpol system disproportionate and unjustified.
The following decision was made:
- to recognize the data as inconsistent with Interpol’s rules,
- to remove the information about the petitioner from Interpol’s files,
- to cease the use of international search mechanisms in relation to the petitioner.
This decision means the complete removal of the person from Interpol’s international systems and the restoration of their rights to freedom of movement without the risk of being detained by Interpol.
Conclusion
This case is a vivid example of the following:
- Interpol is not a tool for pursuing minor cases,
- the expiration of the statute of limitations is decisive,
- even an active diffusion can be completely removed,
- a well-constructed legal position leads to the complete removal of international restrictions.
